Drafting And Enforcing Restrictive Covenants

We routinely advise employers in relation to the enforceability
of post termination restrictions.

Restrictive covenants are an important tool to protect a
business’ interests. We routinely advise employers and senior
executives in relation to the enforceability of post termination
restrictions and employee confidentiality requirements.
We draft documentation on behalf of clients to maximise the
prospect of the enforceability of such provisions, together with
taking steps to protect our clients’ interests to enforce
restrictions.
Such steps often include pre-action correspondence with
individuals and their legal representatives, together with a
full range of appropriate legal remedies, such as actions for
recovery of damages and enforcement by way of injunctions.
Recent examples of work in this area include:
- Assisting our commercial litigation colleagues with the
enforcement of restrictive covenants, including applications
for injunctions and search and seize orders.
- Advising a former senior employee accused of misuse of
confidential information and database rights issues.
- Advising a senior employee and new employer in relation
to allegations of breach of restrictive covenants and theft
of confidential information.
Please contact a member of the employment team to discuss any
issues relating to restrictive covenants.
