Our specialist mediation and arbitration solicitors provide
professional, practical and clear advice.
Court proceedings are frequently necessary and our solicitors
are fully conversant and experienced in commencing and
conducting Court proceedings through to High Court and County
Court trials and have dealt with cases going to the Court of
Appeal and Supreme Court (formerly the House of Lords). However,
parties are encouraged, and now required, by the Court to
consider whether their dispute can be resolved out of the
courtroom.
Our Commercial Litigation solicitors all have experience of
conducting “round table meetings” and formal Mediation Meetings
with an Independent Mediator. Recent cases we have settled at
mediation and round table meetings include:
An international settlement involving the parties and
their lawyers meeting in Romania to settle a claim brought
by our client for over US$1.1 relating to oil exploration
equipment.
Settlement of a claim brought by our client for
negligent advice against IFA. As well as the Financial
Advisor the Defendants’ insurers were involved and
settlement was successfully negotiated.
Settlement of a claim at mediation against a surveyor
who had undertaken a negligent valuation and survey
Settlement at mediation of a claim for ownership of, and
a share of the profits generated by, a network of former
“Blue John” mines in Derbyshire now operating as a
successful tourist attraction.
Settlement of a claim against an employee who had
operated a competing business.
Settlement of a neighbour dispute.
Attendance at a round table meeting in connection with a
dispute relating to defects in a high performance sports
car. Although the settlement meeting did not result in an
agreement at that stage the claim was ultimately successful
at trial.
Mediation requires not only a detailed knowledge of the claim
but also firm negotiating skills in circumstances where parties
are often entrenched in their views. Mediation can result in a
continuation of a business or personal relationship which may
have otherwise broken down. Our Commercial Litigation solicitors
will advise on the best time to try to settle the dispute in
this way and there is often a saving of time, costs and
aggravation.
